1. Introduction
Welcome to myflippix! ("us", "we", "the Site", "myflippix.com"). We are delighted that you ("you") have decided to join our photobook community. Before you begin, it is important that you read the following Terms of Service ("Terms") carefully.
By entering and using the Site, you indicate that you accept these Terms and that you agree to be bound by them. Acceptance of these Terms creates a binding contract between you and myflippix! that you will use the Site only in a manner consistent with these Terms. If you have questions about these Terms, please contact Customer Service at cs@myflippix.com . Your use of the Site and its services (together, the "Service") is entirely conditioned on and subject to your compliance with these Terms. If you do not agree with these Terms, do not access or use the Service.
myflippix! reserves the right, at our sole discretion, to change, modify, or otherwise alter these Terms at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof. Please occasionally review the Terms to keep yourself apprised of any changes. Your continued use of the Service following the posting of changes and/or modifications will constitute your acceptance of the revised terms and conditions.
2. Legal Age Requirements
There is no legal age requirements to use our Service. If you or your parent or guardian has any concerns, please contact us at cs@myflippix.com
3. Use of Site
Under these Terms, you may NOT place any of the following material or obtain any such material using the Service:
Any material that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, defamatory, libelous, vulgar, illegal or otherwise objectionable;
Any material that could infringe on the rights of publicity, privacy or copyrights without the approval and consent of the owner of these rights and the persons (or their parents or legal guardians, where applicable) who are shown in the material;
Any material sent from a fake or unknown address that attempts to hide your identity intentionally and/or containing but not limited to viruses, malicious codes, worms, trojan horses which is likely to cause harm to myflippix! or anyone else's computer systems.
Ownership of any submission to myflippix! is wholly retained by the original copyright holder or the customer. The customer bears sole responsibility for unauthorised use of submitted content. myflippix! will not be liable or legally responsible for the content of any submission. Any submission of content by the customer to myflippix! constitutes permission for reproduction by the recipient in the following manner but not limited to published, copied, reworked, removed or distributed in accordance to the requirements to fulfill the Service.
myflippix! does not control the content of the customers' submission and subsequent publication and does not have any obligation to monitor such content for any purpose. However, myflippix! reserves the right to move or delete submissions that we, in our sole discretion, deem offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, defamatory, libelous, vulgar, illegal or in violation of trademark or copyright laws or otherwise unacceptable.
4. Payment
All prices and amounts shown on the Site are in Ringgit Malaysia (RM), unless otherwise stated. Once payment is made and image files are uploaded for printing, no further changes are allowed because our printing workflow is fully automated and as such, all image files are sent for printing almost immediately upon receipt.
Kindly note myflippix! will not process any orders until full payment is received. Payment can be made via :-
a. Credit card
b. Online bank transfer
c. Cheque
d. ATM transfer
e. Cash at our facility
5. Quality Assurance
myflippix! cannot be held responsible for damage or loss of files submitted either online, by mail or any other submission methods. You acknowledge that the quality of prints in relation to myflippix! products is dependent on the source resolution and quality of the digital files submitted. You are advised to preview all image files prior to placing an order using the built-in preview proof feature in the myflippix! Maker software. myflippix! will not be responsible for any user generated mistakes and cannot guarantee 100% loyal color reproduction. Due to variations with equipment, paper, and ink, as well as environmental concerns such as temperature and humidity, small variations in color are expected in all printing processes. Our liability is strictly limited to clearly identified production errors and flaws only. However, although we cannot correct your typos for you, or re-shoot a dark image due to bad exposure, we are committed to do everything within our capacity to make you a satisfied and long term customer.
6. Delivery
myflippix! uses courier service to deliver the photobooks to you. You will receive your photobooks within 7 working days for domestic orders and 10 working days for international orders from the time payment for your order has been received and image files are sent for production. You may check your order status at http://orders.myflippix.com.
Your orders may be subject to VAT, import duties and/or taxes, which are levied once your package reaches your country. You are required to settle any such charges, if any, in order to clear customs. You are advised to contact your local customs office to enquire more information on VAT, import duties and taxes.
7. Claims & Return Policy
All complaints or claims for defects must be made in writing to cs@myflippix.com no later than 10 days from the date of delivery. If no such claim is made, myflippix! will consider all printed products have been received in good condition and therefore is an acknowledgment that myflippix! has successfully performed all terms, conditions, and specifications.
In the event of a claim, the defective product must be returned to us and myflippix! will, at its sole discretion, determine whether to repair or reproduce the product at no additional charge. However, the cost of returning the product to us is borne by you.
8. Termination of Service
myflippix! may terminate your access to the Service with or without cause at any time and effective immediately, at our sole discretion, including but not limited to your failure to conform to these Terms. myflippix! shall not be liable to you or any third party for termination of use of the Service. Upon termination, your right to use the Service shall cease immediately.
9. Ownership
All printed products are legal property of myflippix! until full payment is received.
However, you agree that the shipping terms for all printed Products are FOB shipping point and ownership transfers to the customer upon shipment. This means that the risk of loss and ownership for such items pass to you upon our delivery to the carrier.
10. Links to Third Party Websites
Links on this website may allow you to leave myflippix!'s site. We are not responsible for the content of other sites, and the inclusion of a link on our site does not constitute an advertisement or endorsement of any other product or company.
11. Indemnity
You agree that you shall indemnify and defend myflippix! and all parties from whom myflippix! has licensed portions of Content, and their directors, officers, and employees, against all claims, liability, damages, costs and expenses, including reasonable legal fees and expenses arising out of or related to (i) your breach of these Terms and Conditions or (ii) any suit, claim, or demand arising from or relating to any text, photograph, image, graphic or other material you incorporated into Products that was not part of the standard Site Content.
12. Disclaimer of Warranty
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT OPERATION OF THE SITE MAY NOT BE UNINTERRUPTED OR ERROR FREE. REFERENCES AND LINKS TO PRODUCTS OR SERVICES OF INDEPENDENT COMPANIES MAY APPEAR ON THE SITE. THESE REFERENCES AND LINKS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL MYFLIPPIX! BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF MYFLIPPIX! HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE USE OR THE INABILITY TO USE THE SERVICE, MATERIAL, OR IMAGES, FROM ANY CHANGES TO THE SERVICE, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL, CONSEQUENTIAL OR OTHER TYPES OF DAMAGES; THEREFORE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Feedback, Forms, and Website Interaction
All feedback, suggestions, letters and internet correspondence submitted to myflippix! become our legal property, and you give us the right to use any ideas contained therein however we see fit. Although we appreciate suggestions from our clients, we do not request them, and you will not necessarily be credited or compensated in any way for your ideas.
